pitiboo.ch is an e-commerce site offering personalised children's books. All content on this site (text, illustrations, logo, structure) is the property of Pitiboo and is protected by Swiss intellectual property law.

2. Terms of sale

2.1 Scope

These terms of sale apply to all orders placed on pitiboo.ch. By placing an order, the customer unconditionally accepts these terms.

2.2 Personalised product

Each book is created to order based on the information provided by the customer. Swiss law does not provide a statutory right of withdrawal for online purchases. Due to their personalised nature, books cannot be returned or exchanged. However, customers benefit from the preview described in article 2.4, which allows them to approve or reject the book before any printing takes place.

2.3 Non-contractual rendering

Illustrations are stylised and inspired by the information provided by the customer (text description and/or photo). They represent an artistic interpretation, not a photographic portrait. Customers are informed of this artistic nature before placing an order. The visual result cannot be guaranteed to match the description or photo exactly.

2.4 Preview before printing

Pitiboo commits to sending the customer a complete digital preview of the book (PDF format) before any printing. Printing only begins after the customer's explicit approval by email. The customer has 7 days to approve or request changes. Without a response after 14 days, Pitiboo reserves the right to proceed with printing the last approved preview.

2.5 Corrections and changes after preview

Corrections due to a Pitiboo error (text mistake, illustration defect, missed or misunderstood order detail) are free and unlimited.

Changes to elements not specified in the original order form, or that the customer wishes to alter after submission, are charged as follows:

• Modification of an illustration (outfit, object, setting...): CHF 5.– per illustration to redo
• Adding a character after the preview is sent: CHF 25.– (flat fee)
• Text edits (dedication, wording): free

The total amount is communicated to the customer before any work begins. Work starts after acceptance and payment of the extra charge.

2.6 Prices and payment

All prices are shown in Swiss francs (CHF), VAT included. Payment is due at the time of ordering. Pitiboo accepts the following payment methods:

• Credit and debit cards (Visa, Mastercard)
• Bank transfer

2.7 Delivery

Delivery is made within Switzerland and Liechtenstein via Swiss Post. Indicative lead times are 7 to 10 business days after preview approval. Pitiboo cannot be held responsible for delays caused by Swiss Post.

2.8 Refund policy

Due to the personalised nature of the products, refunds are granted only in the following cases:

• The customer is not satisfied with the preview after free corrections: full refund on request, before approval and printing.
• The delivered book has a confirmed printing or manufacturing defect: free replacement or full refund.

No refund is granted once the book has been approved and printed, except for manufacturing defects.

2.9 Applicable law

These terms of sale are governed by Swiss law. Any dispute shall be submitted to the competent jurisdiction of Pitiboo's registered address.

3. Privacy policy

3.1 Data controller

Pitiboo is responsible for processing personal data collected on this site, in accordance with the Swiss Federal Act on Data Protection (FADP/revFADP).

3.2 Data collected

As part of an order, we collect:

• Name, surname and delivery address
• Email address and phone number (optional)
• Descriptive information about the child (first name, age, physical traits, personality)
• Photos of the child (if premium option selected)
• Payment data (processed by our secure payment providers Stripe and Shopify; we store no banking data)

3.3 Use of data

Your personal data is used exclusively to:

• Process and deliver your order
• Send you the digital preview of your book
• Contact you if needed regarding your order
• Create the personalised illustrations for your book

Your data is never sold, rented or passed to third parties for commercial purposes.

3.4 Sub-processors and international transfers

To fulfil your order, certain data is passed to providers who process it solely on our behalf:

• Infomaniak (Switzerland): site hosting. Your browsing data stays in Switzerland.
• Shopify and Stripe (Ireland / United States): order and payment processing.
• OpenAI (United States): generation of personalised illustrations (child description and, if you choose this option, their photo).
• Gelato (Norway, printing within the European network): book printing and shipping (name and delivery address).
• Make (European Union): order processing automation.

These international transfers rely on safeguards recognised by the FADP (countries offering adequate protection, standard contractual clauses, or Swiss-U.S. Data Privacy Framework certification for US providers).

3.5 Data retention

• Order data (name, address, email): retained for 5 years for accounting and tax purposes.
• Child descriptions: deleted within 30 days of delivery.
• Children's photos: deleted within 30 days of delivery.

3.6 Your rights

Under the FADP, you have the following rights:

• Right of access to your personal data
• Right to rectification of inaccurate data
• Right to deletion of your data
• Right to restriction of processing
• Right to object to processing
• Right to receive your data in a common electronic format (portability)

4. Use of children's photos

Protecting children is an absolute priority for Pitiboo. By sending us a photo of your child, you agree to the following:

• You confirm you are the parent or legal guardian of the child photographed.
• You authorise Pitiboo to use this photo solely to create the illustrations for the book ordered.
• AI processing: to produce the illustrations, your photo may be passed to a third-party AI service (an image generation provider). This service processes the photo for the sole purpose of creating the illustrated character and is subject to a data processing agreement compliant with applicable law.
• The photo is never published, shared publicly or used for commercial purposes by Pitiboo.
• The photo is not used to train AI models by Pitiboo. However, the AI provider's own terms may include their own usage policy, which we invite you to consult on request.
• The photo is deleted from our systems within 30 days of delivery of your book.

If you do not wish your child's photo to be processed by an AI service, choose the "description only" option when ordering. The illustration will then be created solely from your text description.

5. Cookies and analytics

Our site uses essential technical cookies required for the site to function (order session), which do not require prior consent.

We also use Google Analytics 4, an audience measurement tool provided by Google. It helps us understand how the site is used (pages visited, visitor origin) in order to improve it. The data collected is pseudonymised and transmitted to Google (United States), which participates in the Swiss-U.S. Data Privacy Framework. We do not use advertising cookies.

You can block audience measurement by installing the Google Analytics opt-out add-on or by using a content blocker.
